You acknowledge and agree that AI image-generation technology is inherently imperfect, and that results may include distorted facial features, unnatural color rendering, unintended visual artifacts, or results that you may find unappealing or offensive. You use the Service and rely on its output entirely at your own risk.

15. Limitation of Liability

BECAUSE THE SERVICE IS PROVIDED FREE OF CHARGE, YOU AGREE THAT OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE SHALL NOT EXCEED ZERO DOLLARS ($0.00). IF A COURT OF COMPETENT JURISDICTION DETERMINES THAT THE FOREGOING $0 CAP IS UNENFORCEABLE, OUR TOTAL LIABILITY SHALL NOT EXCEED FIFTY DOLLARS ($50.00).

16. Indemnification

You agree to indemnify, defend, and hold harmless Change My Hairstyle and its officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:

18. Dispute Resolution and Binding Arbitration

18.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to its conflict-of-law provisions.

18.2 Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

You and Change My Hairstyle agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (collectively, “Disputes”) shall be resolved exclusively through final and binding arbitration, rather than in court, except that either party may bring an individual action in small claims court if the claim qualifies.

Arbitration shall be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, which are available at www.adr.org. If the AAA is unavailable, the parties shall mutually select an alternative arbitration provider.

The arbitration shall take place in Muskegon County, Michigan, or, at the election of the claimant, may be conducted by telephone, via video conference, or based solely on written submissions.

Each party shall bear its own costs and attorneys’ fees in connection with the arbitration, unless the arbitrator determines that applicable law requires otherwise.

18.3 Class Action Waiver

YOU AND CHANGE MY HAIRSTYLE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.

18.4 Opt-Out Right

You may opt out of this arbitration provision by sending written notice to us using our contact form within thirty (30) days of first accepting these Terms. Your notice must include your name, mailing address, and a clear statement that you wish to opt out of the arbitration clause. If you opt out, either party may pursue claims in the state or federal courts located in Muskegon County, Michigan, or the Western District of Michigan, and you consent to the personal jurisdiction of those courts.

18.5 Small Claims Exception

Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within the jurisdictional limits of such court.

19. Changes to Service

We may change or discontinue any part of the Service at any time without notice.

20. Amendments to Terms

We may update these Terms from time to time. Continued use of the Service means you accept the updated terms.

21. Waiver and Severability
